"The misapplication of forensic science has been identified as one of the
leading contributors to wrongful convictions in the United States. Legal
scholars, academics, and executive reports have criticized the forensic
sciences and offered ways to improve their procedures and to avoid giving
misleading testimony. Relative to other forensic sciences, a newer forensic
science has recently been used to assist the courts. This science is called
forensic gait analysis and involves comparing a suspect’s gait to a culprit’s
gait captured with crime surveillance. In this chapter, we will critically
examine forensic gait analysis by presenting cases that include forensic gait
analysis evidence, empirical research that investigates whether people can
identify others by their gait, and an evaluation of forensic gait analysis
under the UK and US admissibility standards. Following this, we discuss the
problems with forensic gait analysis (e.g., lack of scientific basis). After
reviewing these issues, forensic gait analysis is premature in its ability to
assist the court given the lack of a scientific foundation (e.g., lack of a
data base). To conclude, we recommend that the use of forensic gait analysis be
limited and/or receive vigilance from the legal system."
